Company search engine giant, Google, felt uneasy with the advent of search engines for free information Groovle.com. Groovle intentionally resembles Google in terms of look and layout of pages.
Google mentions as many as 207 Canadian companies have incorporated Groovle clearly chose the name to create a confusing similarity. Google agreed, making the domain name must first transfer the data to Google.
Responding to this dispute, the mediator from the National Arbitration Forum (NAF) has said that Google did not need to provide any evidence of confusion that is happening. Mediation team agreed with the arguments given by the Canadian company, which believes that a similar Groovle more groovy than a groove or Google. Thus the information quoted from the Telegraph.
Providing domain name may be canceled or moved to another company if they do not pay attention to three elements that are forbidden to be violated. First, the granting of domain names have in common are identical and create confusion. Second, the domain name owner has no right to own patents. Third, those who feel harmed should indicate that the destination domain appearance was categorized dropped with intent.
NAF mediator decides that Google is considered the objections submitted failed to establish the three elements. In other words, the presence Groovle.com otherwise not incriminate other companies domain.
There is a message at the bottom of the page Groovle that says “Groovle.com not owned, sponsored or endorsed by Google.” But not known whether this information has been added since the NAF decision was issued or not.
